If you are required by a court to get an SR22, you could be paying very high rates for car insurance for the next three years. If you do get an SR22, make sure you make your insurance payments on time and, of course, do not get another driving violation.

The SR22 form is sometimes referred to as SR22 insurance, but the SR22 is not insurance. It is a form that your insurance company sends to the State of Alaska verifying that the person referred to on the form, a high-risk driver due to driving convictions, does in fact have car insurance. The SR22 form specifies that the person driving in Alaska has the minimum insurance that the state requires. For the State of Alaska,the minimum car insurance you need is: bodily injury liability — $50,000 per person and $100,000 per accident; property damage liability — $25,000 per accident; uninsured/underinsured motorist bodily injury — $50,000 per person and $100,000 per accident; and underinsured motorist property damage –$25,000 per accident.

As a high-risk driver in the State of Alaska, your car insurance going forward, probably for the next three years, will be 200%, 300% or higher than good drivers in the state. The best tip we can give you is that if you are required to have an SR22 in Alaska, make sure to pay all of your insurance premiums on time. If you fall behind, the insurance company will cancel you out and inform the state. The state will revoke your driver’s license.

The SR22 is a court-ordered document. If you are caught driving without a license; if you are convicted of a DUI (driving under the influence) or a DWI (driving while intoxicated); if you have a lot of “your fault” accidents; if you have repeat offenses in a short period of time; if you don’t pay child support–you could be hit by a court order to get an SR22 to drive a car legally in your state.

The SR22 is a document that is submitted to your state department of motor vehicles that furnishes proof to the DMV that you have the minimum car insurance required by your state. Sometimes people refer to it as SR22 insurance, but the SR22 is simply a document that “proves” you have insurance. The SR22 document is also known as an SR22 bond, an SR22 form, and a “Certificate of Financial Responsibility.”

The SR22 for High-Risk Drivers

The SR22 typically costs about $25 to obtain, this does not count the cost of the car insurance you will need to buy…it will be costly because the insurance company has determined that the person in need of an SR22 is of higher risk than the typical driver. You will pay a lot of money and get only the minimum insurance required in your state. In addition, you may have to shop around for this coverage because your current insurer might cancel your car insurance policy after you are convicted of that serious driving violation.

Not every state requires an SR22 form. Some states do not. These include Delaware, Kentucky, Minnesota, New Mexico, New York, North Carolina, Oklahoma and Pennsylvania.

Some states—Florida and Virginia for example—use what is called an FR-44. This form in Florida and Virginia is usually only required after a DWI or DUI conviction. In the case of the FR-44, the person receiving the form is required to carry liability limits double the state’s minimum.

Insurance companies often specialize in the types of drivers that they will cover with an insurance policy in your state.

There is the so called preferred driver, the standard driver and the non-standard driver.

  • Preferred drivers. These are the people with great driving records, short commutes, typically they are low mileage drivers. In short, everyone loves them. They have little or no accidents and therefore their annual insurance policy money is pure profit. They also have great credit scores.
  • Standard drivers. The name sounds sort of all right…”standard,” but they have a few issues. These are drivers who may have not had much driving experience yet, really put on the miles during the year and sometimes have minor accidents. They get charged more than the preferred driver.
  • Non-standard drivers. For this group, insurance companies have the expectation that a lot of claims may be made for accidents. These so called non-standard drivers might be teenage drivers, drivers with poor credit scores and drivers with moving violations. Non-standard drivers can be flagged because those are the policy holders who only take policies for the minimum amount of insurance required in their state.

Here’s the rub. If you have a DWI or DUI or another serious violation and need to file and SR22 so that you can get back on the road, you need to look for an insurance company that specializes in non-standard drivers and policies to get the best price. If you go to an insurance company that wants preferred drivers, that high-risk policy you are seeking will likely cost you more than if you went to a company that specializes in non-standard drivers.
The SR22 is not actually an insurance policy, but rather a certificate filed with your state DMV by your insurance company. It informs the state that this particular insurance company is furnishing you with the minimum mandated insurance in that state. How much that company will charge you for that minimum mandated liability coverage is another question. You may wish to carefully shop around and find a policy you can afford. High-risk automobile drivers will likely pay 200%, 300% or more than the preferred drivers.

The SR22 certificate also tells the DMV that you will continue to have your minimum liability coverage for a specific amount of time…it could be three years that you need to get insurance this way. Once you get your SR22 and the minimum liability insurance, do not screw around with late payments. If you fail to pay on time, you could open yourself up to a host of other trouble.

If you are a problem drinker or druggie, make a commitment to never get behind the wheel of a car again and you are using. Take and Uber or walk home from the bar if you must. If this is your first brush with the law this way, consider it a very, very expensive warning sign and get straight.

When you apply for an SR22, it is no foregone conclusion that you will get your license back and be able to drive. The document needs to be presented to a court who will decide. This is serious stuff!

You cannot file out a form and receive an SR22. You need to contact the insurance company that will do business with a high-risk driver and if they agree to furnish you with the SR22, they will submit the paperwork to the court in your state. If you are required by a court to have an SR22, don’t go to an insurance company and try to buy a policy without telling them.

Once the court orders you to get an SR22, you will likely have to carry it for three years. At the end of three years, you are the one that needs to notify the insurance company that you are no longer required to have the SR22 and it will be dropped from your policy and most likely you will start paying a lower rate of insurance. If your insurance rate continues at the same level, you need to talk to a new company about buying automobile insurance.

The thing about an SR22 is that you need to get a clean driving record and keep it clean. If you are paying your insurance payments monthly and you miss a payment, your insurance policy will be cancelled and you will have your driver’s license suspended.

It could happen that you could live in one state and have problems while visiting another state. When you go to court in that other state, there could be a court order that you need to get an SR22. If you have problems in Virginia or Florida, those two states use and FR44, which is similar to an SR22. In these two states, the liability insurance that you are required to carry is double the minimum insurance requirement mandated to other drivers in the two states.

The SR22 Certificate will take one of three forms: an operator’s (non-automobile owner’s) certificate that covers the driver whose license has been reinstated who drives a car that he or she does not own; an automobile owner’s certificate, which is issued to a reinstated driver who owns his or her own car; and the operator/owner SR22 Certificate that is issued to the driver who operates his or her own vehicle and a car owned by someone else.

Many insurance companies will not want to do business with you if you are convicted of a dui or dwi.
